Strata and community title disputes

Strategic advice and representation in strata and community title disputes including mediation, conciliation, the NSW Civil and Administrative Tribunal (NCAT) and all courts.

Matters we act in

Repairs and maintenance of common property and the owners corporation's statutory duties; damage claims by lot owners; by-law enforcement and challenges to invalid by-laws; unauthorised works and orders for rectification; disputes about meetings, elections and governance; appointment of compulsory managers; access disputes; and building management committee and mixed-use scheme disputes.

Our approach

We advise on prospects and costs exposure before proceedings start, use mediation and the Tribunal's processes strategically, and run litigation efficiently when it is the right tool. Dispute work is time costed, with clear costs disclosure and staged estimates; fixed fees are available for discrete steps where the scope allows.

Acting for both sides of the fence

We act for owners corporations and for lot owners (in different schemes), which means we know how the other side thinks — how claims are built, how they are defended, and where matters settle.
